Wuhan Revises Urban Management Rules: What Foreign Founders Should Know
Wuhan has amended and repealed several government regulations covering urban management enforcement, gas pipeline protection, and lake protection. Here is what foreign founders operating in the city should note.
Wuhan Updates Local Regulations Affecting Business Operations
The Wuhan Municipal People's Government has decided to amend and repeal parts of several government regulations. The changes touch on urban management enforcement, gas pipeline facility protection, lake protection, and lake remediation. For foreign founders with entities or operations in Wuhan, these rules affect how premises, signage, waste handling, and site works are treated. Below is a practical summary of the published amendments.
Urban Management Enforcement: Fines and Obligations
Shopfronts, Signage and Advertising
The measures on concentrated administrative penalty powers for urban management have been revised in several areas. Under the amended Article 6:
- Items on balconies and windows: Placing, drying, or hanging items that affect city appearance on balconies and outside windows of buildings along major roads must be corrected when ordered; refusal to correct can lead to fines of RMB 50 to 300.
- Graffiti and scribbling: Writing or carving on roads, public places, or facilities must be removed, with a fine calculated at RMB 50 per location. Those who instruct others to do so face fines of RMB 5,000 to 10,000, rising to RMB 10,000 to 30,000 in serious cases.
- Posting and hanging promotional materials: Posting or hanging materials without approval, or failing to remove outdated or damaged outdoor advertising, must be corrected; refusal can lead to fines of RMB 50 to 500. Organizing unauthorized posting carries fines of RMB 5,000 to 10,000, rising to RMB 10,000 to 30,000 in serious cases.
- Outdoor advertising: Unapproved advertising, or advertising not matching approved requirements and timing, must be dismantled or corrected within a deadline, with a possible fine of RMB 2,000 per square metre, capped at RMB 100,000. Failure to comply can lead to court enforcement.
- Operating beyond the shopfront: Must be corrected; refusal can lead to a fine of RMB 300 per square metre of excess area, capped at RMB 20,000.
Waste, Transport and Greenery
Other amended provisions address waste dumping, vehicle spills, and damage to urban greenery:
- Household waste dumped in non-designated places: fines of RMB 100 to 1,000 for individuals and RMB 100,000 to 1 million for units.
- Waste collection units dumping household waste improperly: fines of RMB 100,000 to 1 million.
- Hazardous waste mixed with non-hazardous waste by research, medical, slaughter, or biological products units: fines of RMB 50,000 to 200,000; refusal to correct raises this to RMB 200,000 to 1 million.
- Vehicles carrying loose or fluid materials without enclosure: fines of RMB 2,000 to 20,000, and vehicles may be barred from roads until corrected. Road surface pollution must be cleared, with a fine of RMB 100 per square metre.
- Unauthorized dumping of construction waste: illegal gains confiscated and fines of RMB 100,000 to 1 million; serious cases may lead to production limits or suspension orders.
- “Three packs in front of the door” responsibility units that fail to perform duties: fines of RMB 50 to 500 if not corrected within the deadline.
Article 14 now lists prohibited acts damaging urban greenery, including building or dumping in green spaces, damaging flower beds and hedges, storing materials on lawns, carving trees or picking flowers, damaging railings and pipes, and placing advertising boards in green spaces. Fines range from RMB 50 to 200, or RMB 300 to 1,000 in serious cases, for carving and picking; other listed acts carry fines of RMB 500 to 3,000, rising to RMB 3,000 to 10,000 in serious cases.
Open Burning, Cooking Fumes and Noise
Open burning of straw and fallen leaves in prohibited areas and periods can lead to correction orders and fines of RMB 500 to 2,000. Burning asphalt, rubber, plastics, leather, waste, and similar materials in populated areas carries fines of RMB 10,000 to 100,000 for units and RMB 500 to 2,000 for individuals.
Catering operators that fail to install or properly use fume purification facilities, or otherwise exceed emission standards, face correction orders and fines of RMB 5,000 to 50,000; refusal to correct can lead to suspension. New or modified catering projects producing fumes, odours, or waste gas in residential buildings or certain mixed-use buildings face correction orders and, if refused, closure and fines of RMB 10,000 to 100,000. Open-air barbecue in prohibited times and areas carries confiscation of tools and illegal gains plus fines of RMB 500 to 5,000, rising to RMB 5,000 to 20,000 if not corrected.
References to the Noise Pollution Prevention and Control Law in Articles 24, 28, 29, and 30 have been replaced with references to the Ecological Environment Code. References to “industry and commerce administration” have been changed to “market supervision and administration,” and the relevant chapter title has been updated accordingly.
Gas Pipeline Facilities and Lake Protection
Under the measures protecting high-pressure natural gas pipeline facilities, Article 14 now provides that where new construction, reconstruction, or expansion genuinely requires changing municipal gas facilities, the gas operator must prepare a change plan, obtain approval from the gas authority, and complete related procedures. The construction unit or contractor must then take remedial measures together with the operator. The construction unit bears the cost of relocation.
The lake protection rules have also been amended. References to “natural resources and planning” have been changed to “natural resources” in several articles. Lake protection plans are to be organised by district governments or the municipal water authority and implemented after municipal government approval, with revisions reported to the original approving body. Environmental impact assessment reports are now referred to as ecological environment impact reports or forms. Unlawful lake filling, reclaiming, damming, or dividing water surfaces can lead to orders to stop, demolition and restoration at the violator's cost, confiscation of illegal gains, and fines of RMB 50,000 to 500,000.
The lake remediation rules are also among the regulations being amended. The published text addresses the role of development zones in Wuhan, including the East Lake High-tech Development Zone and the Wuhan Economic and Technological Development Zone.
